A Regulatory Update Of Contractual Clauses And Privacy Shield
At the heart of a case that could affect the future of private transatlantic data flows is the future viability of Standard Contractual Clauses, a private means of securing legal transfer of personal data out of the European Union (EU) to the United States.
Irish Data Protection Commissioner Helen Dixon wants the case referred to the Court of Justice of the EU to determine whether such contracts are essentially equivalent. She pointed out that, although there were agreements pertaining to details of the case, there also were differences regarding many of the facts. Of the most concern is Section 702, which is up for renewal at the end of the year.
