Criminal records assistance and validation (SAR)

This check provides what is referred to as a Certificate of Good Standing or Uverenje o nekaznjavanju. In Serbia, the Criminal Record Certificate can be requested only by the individual and not by a third party (Subject Access Request) if the individual resides in Serbia. We'll guide and assist the individual in making a Subject Access Request (SAR) for the certificate and validate it. A Certificate of No Conviction will contain the following personal information: • Full name • Personal identity number • Date and place of birth • Names of the individual’s parents If no disclosable information is held on record, this will be stated immediately beneath the personal information. If there are criminal convictions, the disclosure will be entitled to a Certificate of Judgement. In addition to the individual’s personal details, the disclosure will contain information about all spent and unspent convictions. All “spent” and “unspent” convictions are listed and remain indefinitely on an individual’s record. The main categories of criminal conviction in Serbia are: • Violence against the person (Prinuda) • Sexual offences (Silovanje) • Burglary or robbery (Kradja) • Fraud (Prevara) • Criminal damage (Šteta nastala izvršenjem krivičnog dela) • Drug offences (Neovlašćena proizvodnja, držanje I stavljanje u promet opojnih droga) • Motoring offences (Ugrožavanje javnog saobraćaja) In Serbia, criminal records will become “spent” after the following periods of time have elapsed: • For fines and custodial sentences of up to 6 months – 3 years • For custodial sentences between 6 months to 1 year – 5 years • For custodial sentences between 1 and 3 years – 10 years • For custodial sentences between 3 and 5 – 10 years
