What does it check?
This check establishes if an individual has pending criminal proceedings.
This check provides what is referred to as a Contumacy Certificate or Certificado de Contumácia. The certificate is for those interested in establishing any type of legal or commercial relationship (including employment) with an individual who lived in Portugal. It aims to provide certainty that there is no pending judicial proceedings, collection, charge for committing a crime or penalty to be served for the individual - including a fine or whatever - in a regular proceeding, or that the individual has deliberately failed to attend a summons or was notified of a decision to be followed. The criminal record certificate, which contains the criminal record of Portuguese citizens or foreigners who lived in Portugal, only mentions convictions and security measures already handed down and defined by the competent courts, including in relation to sentences already served during a certain period.
