This check establishes if an individual has pending criminal proceedings.
What does it check?
This check establishes if an individual has pending criminal proceedings.
This check provides what is referred to as a Certificate of Pending Charges or Certificato dei Carichi Pendenti. This check is usually required for administrative use, adoption, or labour migration. This certificate contains information about pending criminal proceedings and confirms if the individual has any accusations, various stages of proceedings and judgments. The certificate will not mention some of the data contained in the register such as: • convictions that have not yet become final and which have been granted the benefit of “non menzione” (i.e. “non disclosure”) in the certificate; • judicial measures ordered by a “giudice di pace” (i.e. “judge of peace”); • convictions that have not yet become final relevant to offences punishable only with a fine.
