Criminal record check (proceedings)

This check provides what is referred to as a Certificate of No Criminal Proceedings or Uvjerenje da se ne vodi kazneni postupak. This check identifies if criminal proceedings are being conducted against the individual. This certificate proves that: • no final, legally binding, decision on conducting an investigation has been determined; • no charges have been confirmed; • no judgment has been delivered regarding the issuance of a criminal order; • no judgment which is not legally binding has been delivered. Criminal proceedings can be pre-trial when the authorities are gathering evidence or during a trial. Pre-trial the individual is referred to as the ‘accused’ and during the trial, the individual is referred to as the ‘defendant’. This certificate will reveal if any criminal proceedings have commenced against the individual, whether pre-trial or during a trial. The fact of being accused or being a defendant in criminal proceedings does not imply mandatory conviction. This check is supplementary to the Certificate of No Convictions, which only reports on cases which ended with a judgement against the individual and therefore a conviction.
