We'll establish whether the individual is declared insolvent or whether bankruptcy proceedings initiated against him or her.

This check will confirm whether the individual is declared insolvent or whether bankruptcy proceedings initiated against him or her. The check reveals all types of bankruptcy proceedings including those that were submitted but not yet initiated. Bankruptcy proceedings which ended in a court settlement will be reported in the check. Bankruptcy for individuals is available in Croatia since January 2016 as defined in the Consumer Bankruptcy Act. Consumer bankruptcy proceedings can only be opened if the individual is insolvent, which is defined when the individual is: • unable to meet his or her financial obligations (insolvency) or • for at least 90 consecutive days, he or she cannot fulfil one or more due financial obligations in the total amount of more than HRK 30,000 (insolvency assumptions). Consumer bankruptcy can end out of court (mediation) or through court proceedings: • court settlement or • the bankruptcy of individuals with the period of verification of conduct.
